2. DATA PRIVACY AND SECURITY

The data you provide is kept in strict confidence and in accordance with the provisions of the Privacy Policy. We have appropriate measures in place to ensure the integrity of the provided information.

Ensure the confidentiality and security of your data and account password, and restrict access to your devices to prevent unauthorized use. You are responsible for all activities conducted with your account and password and for taking all necessary measures to avoid their theft.

3. INTELLECTUAL PROPERTY RIGHTS

All ownership and intellectual property rights (including, but not limited to, copyrights, patents, trade secrets, and trademarks) in and to the System, the accompanying printed materials, and any copies of the System, are the property of IDIOMA INTERNACIONAL, its partners, or affiliated companies. Consequently, you should treat the System as any other material protected by international property laws and as stipulated in this Agreement. Any information, documentation, art, or intellectual property disclosed, delivered, or otherwise transmitted by or through the System is the property of IDIOMA INTERNACIONAL, and no license or other usage rights are granted or implied beyond those stipulated in this agreement.

The System may include open-source licenses. The open-source System is licensed and distributed under open-source/free licenses, such as the GNU General Public License (GPL) or the GNU Lesser General Public License (LGPL). Under no circumstances will the Licensor be liable for damages, regardless of origin or connection to the open-source system.

In the event that IDIOMA INTERNACIONAL receives a claim, becomes involved in legal proceedings, or suffers economic losses or damages resulting from a breach of these general terms and the agreement, you will be responsible for compensating the full amount of the loss, including any reasonable amounts incurred by IDIOMA INTERNACIONAL in legal costs, attorney fees, and court costs.

4. SYSTEM ACCESS AND THIRD-PARTY SITES

IDIOMA INTERNACIONAL is not responsible for the content, Terms and Conditions, or Privacy Policies of third-party websites accessed through links available in the System. It is the responsibility of the user to verify such information and accept the conditions imposed by third parties unrelated to IDIOMA INTERNACIONAL. Any link between the System and any other website should not be interpreted as an endorsement of the persons or organizations owning the content of that other website. We offer no guarantees regarding the accuracy, timeliness, suitability, or quality of information on third-party websites and assume no responsibility for any objectionable, inaccurate, misleading, or illegal content provided by other users or third parties, nor for any infringement of third-party rights in connection with such content.

5. LIMITED LICENSE

You may access and view the content of the System from authorized devices. The use of the System and the services offered in or through the System are only for these purposes..

Any distribution, publication, or commercial or promotional exploitation of the System, or any of the content, codes, data, or materials in the System, is strictly prohibited unless you have received prior express written permission from authorized personnel of IDIOMA INTERNACIONAL.

You may not download, post, display, publish, copy, reproduce, distribute, transmit, modify, perform, broadcast, transfer, create derivative works from, sell, or otherwise exploit any of the content, codes, data, or materials on or available through the System. You also agree not to alter, edit, delete, remove, or otherwise change the meaning or appearance of, or change the purpose of, any of the content, codes, data, or materials on or available through the System, including, without limitation, altering or removing any trademark, logo, service mark, or any other proprietary content or rights notice.

You acknowledge that you do not acquire any ownership rights by downloading any copyrighted material from or through the System.

If you use the System, or the contents, codes, data, or materials found therein or available through the System, in any way not specified above, you may violate the copyright and related laws of the Republic of Costa Rica, and you may be subject to legal liability for such unauthorized use.

7. PROHIBITED USER CONDUCT

You guarantee and agree that, while using the System, you will not: (a) impersonate any person or misrepresent your affiliation with any other person or entity; (b) insert your own advertisement, brand placement, or any other promotional content, or that of a third party, into any of the content, materials, or services, nor use, redistribute, republish, or exploit such content or services for any additional commercial or promotional purpose, unless expressly authorized in writing by IDIOMA INTERNACIONAL; or (c) attempt to gain unauthorized access to other computer systems. You will not: (i) engage in unauthorized access to databases to collect email addresses, wireless addresses, or other information, including, without limitation, any information contained on any server or database connected to the System or the services offered on or through it; (ii) obtain or attempt to obtain unauthorized access to computer systems, materials, or information by any means; (iii) use the System or services made available on or through the System in any way that intends to disrupt, damage, disable, overburden, or impair the System or such services, including, without limitation, sending unsolicited mass messages or “flooding” servers with requests; (iv) use the System or the services or items of the System in violation of intellectual property or other legal or proprietary rights of IDIOMA INTERNACIONAL or any third party; or (v) use the System or the System’s services in violation of any applicable law. You agree not to attempt (or encourage or support others in attempting) to cheat, destroy, decrypt, or otherwise alter or interfere with the System or the System’s services, or with any content of it, or make any unauthorized use thereof. You agree not to use the System in any way that could damage, disable, overload, or impair the System or interfere with any other person’s use or enjoyment of the System or any of its services. You will not obtain or attempt to obtain any materials or information through any means not intentionally made available to the public through the System. IDIOMA INTERNACIONAL reserves the right to use and access the System.

8. INDEMNIFICATION

You agree to defend, indemnify, and hold IDIOMA INTERNACIONAL and its directors, officers, employees, agents, and affiliates harmless from any claims, liabilities, costs, and expenses of any kind, including attorneys’ fees, incurred as a result of your use of the System, your posting or transmission of any message, content, information, software, or other materials through the System, or your violation of the law or these Terms and Conditions.

IDIOMA INTERNACIONAL reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with IDIOMA INTERNACIONAL in the defense of such claim.

9. DISCLAIMER OF WARRANTIES

INTERNATIONAL LANGUAGE assumes no responsibility, and will not be liable for any damage to or any virus that may infect your equipment due to your access to, use of, or browsing in the System or your downloading of any data, text, images, or content from the System. If you are dissatisfied, please discontinue using it.

IDIOMA INTERNACIONAL makes its best efforts to ensure that the information published is correct and updated, and therefore reserves the right to change or make corrections to any information provided at any time and without prior notice.

IDIOMA INTERNACIONAL neither endorses nor is responsible for the accuracy or truthfulness of any offensive, defamatory, obscene, indecent, illegal, or violative publication made by any person unaffiliated with IDIOMA INTERNACIONAL.

10. LIMITATION OF LIABILITY

In no event, including but not limited to negligence, will IDIOMA INTERNACIONAL or any of its directors, officers, employees, agents, or suppliers be liable for any direct, indirect, special, incidental, consequential, exemplary, or punitive damages resulting from, or directly or indirectly related to, the use of, or the inability to use the System.

The use of the System is at your sole risk. IDIOMA INTERNACIONAL makes no warranties regarding the use or the results of the use of the System with respect to performance, accuracy, reliability, security, capability, timeliness, or other aspects. There is no guarantee that the operation of the System will be uninterrupted or error-free.

12. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are governed by the laws of the Republic of Costa Rica. The user irrevocably agrees to the jurisdiction specified.

13. CHANGES TO TERMS AND CONDITIONS

IDIOMA INTERNATIONAL reserves the right to change, modify, add or remove any portion of the Terms and Conditions in whole or in part, when deemed necessary, at any time and without prior notice.

If any provision of this Agreement or its application to any person, place, or circumstance is declared null or illegal by a competent authority, such declaration shall not affect the validity, legality, and enforceability of the remaining provisions, or their application to other persons , places, or circumstances.
